Physician Prevails at the Texas Medical Board in Sexual Misconduct Complaint

Serpe Andrews successfully defended a physician at the Texas Medical Board from a complaint accusing him of providing poor medical care, and sexual misconduct with a patient. Attorneys Matt McCracken and Maggie Garib argued that the patient and her husband orchestrated the sexual misconduct complaint by staging meetings between the physician and the patient outside the practice. The couple also sent provocative photographs and text messages to the doctor in an attempt to create evidence of an inappropriate relationship. In concert with their complaints, the couple demanded a substantial amount of money from the physician and his employer. The Board ultimately found that the physician met the standard of care with respect to his medical care and treatment of this patient. In addition, they found no evidence of an inappropriate sexual relationship and dismissed the complaint.
