Licensure Hearing at the Texas Medical Board

Serpe Andrews recently prevailed in an appeal to the Licensure Committee of the Texas Medical Board. Matt McCracken appealed a decision requiring a physician who recently moved to Texas to agree to a Remedial Plan as a condition of receiving a license to practice medicine in Texas. The Board alleged the doctor fraudulently failed to disclose a previous investigation by another state’s medical board. But the Licensure Committee unanimously reversed the requirement for a Remedial Plan when Mr. McCracken presented evidence at a hearing before the Board that the other state’s inquiry would not be considered an “investigation” under the Texas Medical Board’s own rules. Therefore, there was no “investigation” that required the doctor’s disclosure. The Board agreed and granted the physician an unrestricted license to practice in Texas.
